A döntés ellen történt felebezés (lent linkelve) nem is vonja ezt kétségbe, hogy Trump elkövette volna ezeket vagy sem, hanem arról értekezik, hogy a fenti törvény nem vonatkozott az elnöknek a hivatalánál fogva mikor ezt tette. Valamint, hogy a szólásszabadság és a jelölt állítás szabadságát ami az alkotmány első módosításában van.
